公务员的人事处理决定可诉性探析
摘要：综观世界各国，大多数国家对于公务员的人事处理决定的行为都规定了相应的行政救助和司法救济，体现了司法最终救济原则，以最大限度地保护公务员权利。反观我国，对于公务员的权利救济只涉及行政救助，并未引入司法救济，致使我国公务员的权利救济存在欠缺之处。故我国应将公务员的人事处理决定纳入行政诉讼范围中，以便更好地完善公务员的权利救济途径。

Analysis of the justiciability of the decision of personnel punishment to civil servants

Summary：Take a comprehensive view of countries of the world ,the most countries had made provisions of administrative remedy and legal remedy for the decision of personnel punishment to civil servants ,which embodies the principles of legal remedy and makes the maximum protection to the rights of civil servants . Look on our country, the remedy for rights of civil servants merely refer to administrative remedy, not yet introduce the legal remedy principle, which causes the disability of relieving rights. Hence, in order to improve the way of relieving rights, the decision of personnel punishment to civil servants should be included in the scope of administrative litigation
